According to officer from DG Sante, business operators are failing to take responsibility for reporting information to the European Commission that could affect the safety assessment of substances approved for use under the food contact materials (FCMs) Regulation.
The Regulation allows the Commission to establish a positive list of substances authorised for use in a particular material. The plastics FCM Regulation, for example, includes a positive list of more than 1,000 approved chemicals.
The FCM Regulation (Article 11(5)) requires an authorisation applicant, or any business operator using an authorised substance or material or article containing one, to immediately inform the Commission of any new scientific or technical information which might affect the safety assessment of the substance in relation to human health.
Speaking at Chemical Watch’s Food Contact Regulations Europe 2020 conference in Brussels last week, DG Sante’s Bastiaan Schupp said that in more than eight years of working on FCMs, he had received just two submissions; despite the legal obligation, companies have rarely submitted such information
He said he would be “really surprised” if no new information has emerged for the 1,000 substances approved for plastics. “Operators aren’t taking on their responsibilities, and that’s really a problem.”
The European Food Safety Authority is currently reviewing a large number of substances without a specific migration limit to see if they require one, and if so prioritise their possible re-evaluation to establish these.
“If we see that some are problematic but we don’t have any data on them [for their re-evaluation], we will assume they are no longer on the market and we will take them off the positive list – that’s a real warning to you,” he told delegates.
